Official Rules

 

Radio Networks, LLC (“Cumulus Media Networks” or the “Administrator/Sponsor”) will conduct the “DARLINGTON RACE PACK” Sweepstakes (the “Sweepstakes”) in the Red Eye Radio show substantially as described in these rules. Daimler Trucks North America LLC is the prize provider (“Prize Provider”). Administrator/Sponsor, Prize Provider, their respective parent, affiliate subsidiary and successor companies, and/or their advertising/promotional agencies are hereinafter known as the “Released Parties.”  By participating, each participant agrees as follows:

1. No purchase is necessary.  Void where prohibited.  All federal, state, and local regulations apply.

2.   Only legal residents of the Continental U.S. and Washington, DC (EXCLUDING, WITHOUT LIMITATION, U.S.  RESIDENTS IF LOCATED IN OVERSEAS MILITARY INSTALLATIONS, PUERTO RICO AND OTHER U.S. TERRITORIES) age 21 or older with a valid Social Security number and Commercial Driver’s License (a “CDL”) at the time of entry are eligible to participate in the Sweepstakes. Employees, agents, representatives, or affiliates of the Administrator/Sponsor, its subsidiaries and affiliates, Released Parties including Penske Racing South, Inc., and their immediate family members and household members are not eligible to participate.  The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.

3. Only one (1) prize per person, family or household awarded via the Administrator/Sponsor is permitted every 90 days.  
4. The Sweepstakes will begin at 12:00 am CT, April 22, 2013 and will run through 5:00 pm CT May 3, 2013 (the “Sweepstakes Period”). 
5. There are two ways to enter this Sweepstakes. Randomly selected winners will be pulled from a combined pool of valid entrants received via both methods of entry.

a) Text-Entry. Listen to affiliated Red Eye Radio stations during the Sweepstakes Period.  The Administrator/Sponsor will air promos inviting listeners to text the word “PARTS” to 68683 on their mobile phones to be entered. Each entrant who submits a text entry will receive a bounceback message confirming their entry. Each entrant will also be enrolled in the Red Eye Radio mobile club.  They will receive an additional text message welcoming them into the Red Eye Radio mobile club, along with instructions for them to opt-out if desired.  The mobile club will send information via text message about show updates, offers, future sweepstakes and promotions directly to the mobile phone used to submit the text entry if they choose to remain in the club. There is no limit to the number of times a listener may submit a text message entry.  Text entries must be received by 5:00 PM CT on 5/3/13.

 

Text message based entry into any sweepstakes is subject to the sweepstakes rules, and Cumulus privacy policy. Standard text messaging rates, as established by an individual’s wireless carrier, may apply.  Any and all fees arising out of the transmission of a text message shall be the sole responsibility of the entrant.  By participating in a sweepstakes in which text message-based entry is permitted, entrants acknowledge that text messages are distributed and delivered through third party providers; Administrator/Sponsor does not guarantee, and shall not be responsible for, the delivery or timeliness of any text message entry.  Administrator/Sponsor will at all times consider the time that a message is logged as arriving in its system as being the time of entry, regardless of the time at which the entrant attempted to send the entry and any technical problems or other complications that may have delayed its delivery.  Administrator/Sponsor is not responsible for service outages, message failures, transmission delays or any other factor affecting the availability or performance of the text messaging service. By participating in the sweepstakes, entrants agree that the Administrator/Sponsor may contact that entrant at the telephone number from which the text message entry was received.  All text message entries must come from a valid and identifiable telephone number.  Administrator/Sponsor reserves the right, in its sole discretion, to disqualify any entry if that entry’s source and sender cannot be reasonably determined.  Administrator/Sponsor, through its third party text messaging administrators, will store all messages received on its system.  Administrator/Sponsor may require, on request, proof of identity as to the rightful owner of the phone number from which the text message entry was sent.

 

In the event of a dispute as to any text-entry registration, the authorized account holder of the mobile phone used to register will be deemed to be the registrant and he/she must be eligible according to these Official Rules.  The “authorized mobile phone account holder” is the natural person listed on the account by the cellular service provider, associated with the mobile phone number used to submit the text entry. 

 

b) Online Entry. To submit an on-line entry, visit www.RedEyeRadioShow.com during the Sweepstakes Period and fully complete the online entry form on the Sweepstakes Information page as part of the Red Eye Radio Rewards program. If you are a current member, sign-in with your e-mail address and password, and provide any additional information that may be required for this particular sweepstakes prior to submitting your entry. If you are not a current member, you may register for the Rewards program by completing all of the required information and then submit your entry into the sweepstakes. Any on-line entry submitted with an invalid email address, or any other deficiency, will be disqualified.  Any available opt-in opportunities are not required to enter the Sweepstakes, and checking the opt-in boxes will not improve your chances of winning.  One online entry, per person, per email address is permitted in this sweepstakes.  On-line entries must be received by 5:00 PM CT on 5/3/13.

 

In the event of a dispute as to any on-line registration, the authorized account holder of the e-mail address used to register will be deemed to be the registrant and he/she must be eligible according to these Official Rules.  The “authorized email account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.

   

6. Winner Selection:

One (1) Grand Prize Winner will be randomly selected on or about May 3, 2013 from all eligible entries received. Winners will be notified by phone number and/or email address provided when entering. If it is determined that a candidate is not eligible to receive a prize, in the Administrator/Sponsor’s sole judgment and discretion, another candidate will be randomly selected for eligibility consultation and this process will continue on until such time as an eligible candidate is found, time permitting.  In the unlikely event that no candidates are found to meet the specifications, then the prize(s) will go un-awarded.

One (1) Grand Prize will be awarded.  Grand Prize consists of 2 general admission tickets to the NASCAR Nationwide Series VFW Sport Clips Help A Hero 200 race in Darlington, SC on Friday, May 10th at 7:30pm ET, $25 Alliance Truck Parts gift card, and an 8000 Pro HD GPS Unit courtesy of Cobra Electronics. Total Approximate Retail Value of Grand Prize: $ 499.00.  Winner is not entitled to the difference between the approximate retail value and the actual value of the Grand Prize.

 

Prize package must be claimed in person at Triple T FTL, STL, WST, Inc. 190 WEST FREIGHT ROAD, FLORENCE, SC 29501, 843-143-0801, prior to Thursday, May 9, 2013 at 5PM ET. If for any reason the Grand Prize Winner cannot attend the race or cannot retrieve prize prior to deadline, the prize will not be awarded and sponsor is not responsible for awarding any compensation in lieu thereof and an alternate winner will not be selected.  Grand Prize Winner will be required to sign and complete an Affidavit of Eligibility and Liability Release, and, where legal, Publicity Release at the time of prize acceptance. Winner is solely responsible for any and all expenses relative to participation in this Sweepstakes and acceptance of the prize not specified herein as being provided including any and all travel to/from the Alliance Truck Parts dealer to claim the race ticket portion of prize, any and all travel to/from the race destination city and any expenses incurred while attending the race. Administrator/Sponsor and Prize Provider will not replace any lost or stolen tickets, travel vouchers, certificates, or prize items.  In the event the Grand Prize winner engages in behavior that (as determined by the raceway security’s sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, raceway security reserves the right to terminate the prize or other applicable experience early, in whole or in part, and send the winner home with no further compensation.  No prize substitutions except at Administrator/Sponsor’s and/or Prize Provider’s sole discretion for prize of comparable or greater value.  Winner cannot redeem prize for cash, except that Administrator/Sponsor and/or Prize Provider reserves the right in its sole discretion to award the actual cash equivalent of any prize in lieu of the prize itself.  Any prize is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

 

7. Odds of winning depend on number of eligible entries received. 
8. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or prizes valued at $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
9. As a condition to receiving the prize, any potential winner must respond to a prize notification email and/or call to confirm their eligibility within twenty-four (24) hours of prize notification transmission.  Should, email or phone message be unreturned or nondeliverable, an alternate potential winner will be selected as time allows. Any attempted contact by the Administrator/Sponsor and/or required winner documents previously mentioned herein not returned by a potential winner will forfeit awarding anyone the Grand Prize. Winner, by acceptance of the prize, agrees to release all Released Parties, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize. In the event of non-compliance with these requirements, any potential winner may be disqualified and an alternate winner selected, time permitting.  Prize returned as undeliverable or otherwise not claimed after being sent will be forfeited.
10. By participating in this Sweepstakes, each participant agrees to waive any and all claims for damages for death, personal injury, loss of property or property damage that he or she may sustain as a result of his or her participation in the Sweepstakes and/or the use of any prize, and any damages or losses arising from the implementation or carrying out of the Sweepstakes or any participant’s failure to win the Sweepstakes or receive the prize, and to release the Released Parties from any and all liability arising out of or connected in any way with his or her participation in the Sweepstakes, even though that liability may arise out of an intentional act, omission, negligence or carelessness on the part of the Released Parties.
11. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Administrator/Sponsor to be used, disposed of or destroyed in its sole discretion.  The Administrator/Sponsor is not responsible for any incorrect or inaccurate information entered by website users, and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Administrator/Sponsor’s website. 
12. All entrants and winners agree to give the Administrator/Sponsor and/or Prize Provider and its licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish their name, city of residence, sweepstakes entry comment, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Administrator/Sponsor and/or Prize Provider deems necessary without compensation, unless prohibited by law.  All winners release, discharge, and agree to hold the Released Parties harmless from any and all claims they may have against the Released Parties in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live.  All winners further acknowledge that the Administrator/Sponsor and/or Prize Provider owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to the Administrator/Sponsor and/or Prize Provider.
13. By participating in the Sweepstakes, each participant agrees to receive email and/or phone communications from the Administrator/Sponsor and/or Prize Provider regarding the Sweepstakes.
14. By participating in the Sweepstakes, participants agree to be bound by the decisions of the Administrator/Sponsor and/or Prize Provider. Persons who violate any rule, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Administrator/Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Administrator/Sponsor’s decisions concerning such disputes shall be final.

Administrator/Sponsor is not responsible for any typographical or other printing errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in the printing or posting of the offer or in these Official Rules. Material modifications shall be announced when practical. By participating in this sweepstakes, participants agree to be bound by these Official Rules, any modifications thereof, and by all other rules imposed by Administrator/Sponsor.  If due to circumstances beyond the control of Administrator/Sponsor, any event associated with this sweepstakes or the prize is delayed, rescheduled, postponed or cancelled, Administrator/Sponsor reserves the right, but not the obligation, to cancel or modify the sweepstakes and shall not be required to award a substitute prize. Administrator/Sponsor and/or Prize Provider also reserves the right, in its sole discretion, to cancel or terminate this Sweepstakes due to earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict (whether or not officially declared).

If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Administrator/Sponsor, the Administrator/Sponsor reserves the right to terminate this Sweepstakes, or make such other decisions regarding the administration or outcome as the Administrator/Sponsor deems appropriate. All decisions will be made by the Administrator/Sponsor are final. ANY ATTEMPT BY A SWEEPSTAKES ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS SWEEPSTAKES, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR/SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

15. A winners list may be obtained after June 3, 2013 by sending a self-addressed stamped envelope to “Darlington Race Pack” Sweepstakes WINNER’S LIST, Cumulus Media Networks, 261 Madison Avenue, 3^rd Fl, New York, NY 10016.
